Terms of Service

The service

Kith & Keen provides warm daily conversations and mind-keeping games for older adults, plus tools for family and friends to stay connected. It is designed to help people stay sharp, engaged, and connected — it is a wellness and companionship service, not healthcare.

Not medical advice

Kith & Keen does not provide medical, diagnostic, or treatment services. It does not offer medication advice and makes no claim to treat, prevent, or slow any condition, including memory loss. It is not a monitoring or emergency service. In an emergency, call your local emergency number.

The AI is a computer program

Conversations are generated by an AI assistant, not a human. The assistant will always say so if asked. While we work to keep it warm and appropriate, AI can make mistakes; do not rely on it for factual, medical, financial, or legal decisions.

Accounts & consent

You must be 18 or older to hold an account. If you set up Kith & Keen for another adult (the participant), you confirm you have their consent to create a profile for them and to receive session content and stories on the terms described here. You are responsible for keeping your login secure.

Subscriptions & billing

• Paid plans are billed monthly in advance through Stripe until canceled.
• You can cancel anytime; access continues through the end of the current billing period.
• Referral and gift credits are promotional, have no cash value, and may be changed or ended.
• Prices may change with reasonable advance notice.
• Fraudulent payments or chargebacks may result in immediate suspension or termination.

Acceptable use

Kith & Keen is for your own personal, non-commercial use with the people in your circle. You agree not to:

• Access, tamper with, or use another person's account, data, or a participant's device link without authorization.
• Share, sell, resell, rent, sublicense, or otherwise commercially exploit the service or any account or access link.
• Copy, scrape, harvest, or bulk-download content, or use bots, crawlers, or other automated means to access the service.
• Reverse engineer, decompile, or attempt to extract the source code, models, or prompts behind the service.
• Probe, scan, circumvent, or interfere with the security, authentication, rate limits, or normal operation of the service.
• Upload or share content that is unlawful, infringing, harassing, or harmful, or impersonate any person or organization.
• Use the service to defraud anyone, or submit fraudulent payments or chargebacks.

Ownership & intellectual property

The service — its software, design, content, games, and the Kith & Keen name and brand — is owned by Kith & Keen and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use it as intended. All rights not expressly granted are reserved, and nothing here transfers ownership of the service to you.

Account security

You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly at hello@kithandkeen.com if you suspect unauthorized access to, or theft of, your account or credentials. To the fullest extent permitted by law, we are not responsible for losses arising from someone using your account because your credentials were not kept secure.

Suspension & termination

We may suspend or terminate access — with or without notice — if you violate these terms, misuse the service, or engage in fraud or activity that risks harm to others, to participants, or to the service. You may stop using the service and cancel at any time.

Indemnification

You agree to indemnify and hold Kith & Keen harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the service, your content, or your violation of these terms or of anyone else's rights.

Your content

Stories and memories shared in sessions belong to you and the participant. You grant us permission to process and display them within the service (for example, in a storybook you choose to share). You can keep memories private or turn sharing off at any time.

Disclaimers & liability

The service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Kith & Keen is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid us in the twelve months before the claim.
